With the devastation of Hurricane Sandy and the current state of New Jersey, New York City and beyond, talked and turned to the Presidential election and if it needs to be postponed.  Experts are saying Election Day will go on as planned and here's why:

  • The Presidential Election Day is set by Congress under its authority in the Constitution, and Election Day can only be changed if a new federal law is passed.
  • Individual states will probably be allowed to postpone voting only in disaster-affected areas. Statewide postponement of the presidential vote is an open legal question.
