At approximately 7:30 a.m. Wednesday morning Delaware County Sheriff’s Deputies and members of the Delhi Fire Department responded to a personal injury tractor trailer rollover accident on County Route 16 in the Town of Delhi that resulted in the closure of that roadway for several hours.

Upon arrival at the scene, the Sheriff’s Deputy and first arriving Delhi Fire Department members, utilizing a ladder provided by a neighbor, extricated the driver from the tractor’s cab which was partially suspended from a bridge over Platner Brook.  The driver was subsequently transported to O’Connor Hospital, Delhi, for treatment of minor injuries.

Further assessment of the scene revealed the tractor trailer tanker’s cargo was spilling into Platner Brook.  As a result, members of the Delaware County Emergency Services, Delaware County Haz-Mat Team, Treadwell Fire Department, New York State Department of Environmental Conservation’s Law Enforcement Division and their Spill Response Team, Delaware County Department of Public Works employees, New York State Police Commercial Vehicle Enforcement Unit and the New York City Department of Environmental Protection Police and their Haz-Mat team were summoned and responded to the scene.

Investigation by Deputies at the scene determined that Marcus Franklin, 28, of Houston, Texas, was traveling south on County Route 16 when he lost control of the loaded tractor trailer which left the roadway and overturned on the bank of Platner Brook.

The tractor trailer tanker, owned by Indian River Transport of Winter Haven, Florida, was transporting a bulk tank of cream from Michigan to the Saputo Dairy plant located in Fraser at the time of the accident.  Officials estimate approximately 2500 gallons of cream and a very limited quantity of fuel oil was spilled into Platner Brook.

Deputies issued Marcus traffic summonses for speed not reasonable and prudent, moving from lane unsafely, failure to keep right and a log book violation.

Marcus was also cited by New York State Environmental Conservation Police in relation to the hazardous material spill into the waterway.
